Signing a will
Statute: 84 O.S. § 55 (attested wills); 84 O.S. § 54 (holographic wills).
Under 84 O.S. § 143 a gift to a subscribing witness is void unless the will is also attested by two other competent subscribing witnesses (the will itself stays valid; under the traditional rule the witness may still take up to their intestate share).
Holographic will must be entirely written, dated and signed in the testator's hand, with no witnesses needed (84 O.S. § 54). Electronic wills are allowed under the Uniform Electronic Estate Planning Documents Act, 84 O.S. §§ 901-927 (SB 468, effective Nov. 1, 2024). An electronic will can be made self-proving before an officer, including a remote online notary (§ 907). The self-proving cite (§ 55) comes from secondary sources and the § 143 'intestate share' detail was not confirmed against the official text. Confirm both on oscn.net.
Power of attorney
Statute: Oklahoma Uniform Power of Attorney Act, 58 O.S. §§ 3001-3045 (HB 2548, 2021, effective Nov. 1, 2021; replaced the Uniform Durable Power of Attorney Act).
Durable by default (§ 3004). The National Notary Association reads § 3005 as not requiring notarization. An acknowledged signature is presumed genuine, though, and third parties may refuse an unacknowledged POA, so drafts should always be notarized. A POA used for real estate must be acknowledged and recorded in the county where the land is. The optional statutory form is reportedly at § 3041 (not verified). Hot powers (gifts, trusts, survivorship, beneficiary designations, delegation, disclaimers) need an express grant under the Act's UPOAA § 201 counterpart (exact section number not verified). Electronic signing is permitted.
Health care directive
Called: Advance Directive for Health Care.
Statute: Oklahoma Advance Directive Act, 63 O.S. § 3101.1 et seq.; execution and statutory form at 63 O.S. § 3101.4.
Witnesses must be 18 or older and must not be legatees, devisees, or heirs at law of the declarant (63 O.S. § 3101.4). Some consumer sources also exclude the named health care proxy; use a disinterested non-agent witness to be safe.
The statute calls for an advance directive 'substantially' in the statutory form. The witness rule comes from the engrossed HB 1191 (2017) text and secondary sources, not the current official statute. Secondary sources say there is no notary alternative under § 3101.4 but that a separate health care power of attorney (reported at 63 O.S. § 3111.3, possibly from SB 1094 (2024)) can use a notary or two witnesses. That is unverified, so confirm on oscn.net. Official form URL not found.
If there's no will: what a spouse gets
If all the decedent's surviving issue are also the spouse's issue, the spouse takes an undivided one-half of the whole estate (joint-industry and separate property alike) and the issue take the rest (84 O.S. § 213).
A spouse's right to a share
A spouse left less than an intestate share may elect to take one-half of the property acquired by the joint industry of the spouses during the marriage (84 O.S. § 44(B)).
Estate and inheritance tax
No state estate tax (repealed for deaths on or after Jan. 1, 2010).
No inheritance tax.
Probate
Court-supervised probate is moderately heavy. A small-estate affidavit for personal property is available when the estate is $50,000 or less, 10 days after death (58 O.S. § 393), and summary administration is available for estates up to $200,000 (58 O.S. §§ 241-245). One unverified source says HB 2650 (signed 2026) raises the summary-administration ceiling to $300,000.
